All software, content and materials from the Site, including but not limited to any files, images incorporated in or generated by the Site’s software or content, and data accompanying the software or content (collectively, the “Content”) on the Site are provided for your information, entertainment and educational use, and are copyrighted by Az. Agr. Mannucci Droandi, all rights reserved.
B. Images on the Site of people or places (the “Images”) are the property of, or used with permission by, Az. Agr. Mannucci Droandi You are prohibited from using the Images except as specifically permitted by the Site or this Agreement. Any unauthorized use of the Images by you may violate copyright trademark, privacy, publicity and communications laws, regulations and statutes. With the exception of news media subject to the specific conditions set forth in the Image Gallery portion of the Site, you may not copy, reproduce, republish, upload, post, transmit, distribute, or create derivate works from, the Images. Modification or use of the Images for any purpose not provided for within is a violation of Az. Agr. Mannucci Droandi’s and others copyright and other proprietary rights. For purposes of this Agreement, the use of the Images on any other Web site or networked computer environment is prohibited.
C. The Site is intended to quickly and easily deliver the most requested Az. Agr. Mannucci Droandi company information to information seekers. You may download/print the Content, including the Trademarks and Images. You may not modify, sell, repost, decompile, reverse engineer, or otherwise disassemble or create derivate works from the Content without the express permission of Az. Agr. Mannucci Droandi
II. JURISDICTIONAL ISSUES
A. Unless otherwise specified, the Site Content is presented solely for the purpose of communicating information about Az. Agr. Mannucci Droandi, its company practices and products. The Site is controlled and operated by Az. Agr. Mannucci Droandi from its offices in the State of Italy. Az. Agr. Mannucci Droandi makes no representations that Site Content is appropriate or available for use in other locations. Those who choose to access the Site from other locations do so on their own initiative and are responsible for compliance with laws, if and to the extent local laws are applicable.
IV. TERMINATION
A. This Agreement is effective until terminated by either party. You may terminate this Agreement at anytime by destroying all Site content and all related documentation and all copies and installations thereof which are in your possession, whether made under the terms of this Agreement or otherwise.
B. This Agreement will terminate immediately without notice from Az. Agr. Mannucci Droandi if in Az. Agr. Mannucci Droandi’s sole discretion, you fail to comply with all of its terms or provisions. Upon
termination, you must destroy all materials obtained from the Site and all copies thereof, whether made under the terms of this Agreement or otherwise.
V. NO WARRANTIES
A. SITE CONTENT IS PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, Az. Agr. Mannucci Droandi DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, NON INFRINGEMENT OF INTELLECTUAL PROPERTY, AND FITNESS FOR A PARTICULAR PURPOSE.
B. Az. Agr. Mannucci Droandi DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE SITE OR SITE CONTENT WILL BE UNINTERRUPTED OR ERROR FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR ITS SERVER ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
C. Az. Agr. Mannucci Droandi DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OF OR THE RESULTS OF THE USE OF THE SITE CONTENT IN THIS SITE IN TERMS OF ITS CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. YOU (AND NOT Az. Agr. Mannucci Droandi) ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTIONS WHICH MAY BE REQUIRED AS A RESULT OF YOUR USE OF THIS SITE.
D. APPLICABLE LAW MAY NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.
VI. LIMITATION OF LIABILITY
A. Az. Agr. Mannucci Droandi makes reasonable efforts to place accurate, current Content on the Site; however, Az. Agr. Mannucci Droandi makes no warranties or representations as to its accuracy and assumes no liability or responsibility for any errors or omissions in Site Content. Under no circumstances, including, but not limited to, negligence and gross negligence, shall Az. Agr. Mannucci Droandi be liable for any direct, incidental, special, consequential, indirect, or punitive damages resulting from the use of, or the inability to use, the Site or Content, even if Az. Agr. Mannucci Droandi or an Az. Agr. Mannucci Droandi authorized representative has been advised of the possibility of such damages. In no event shall Az. Agr. Mannucci Droandi’s total liability to you for all damages, losses, and causes of action (whether in contract, tort (including, but not limited to, negligence), or otherwise) exceed the amount paid by you, if any, for accessing the Site.
B. Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you.
VII. AGREEMENT ENFORCEABILITY
A. This Agreement shall be governed by and construed in accordance with the laws of the State of Italy, without regard to any principles of conflicts of law. If any provision of this Agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.
B. This is the entire agreement between the parties relating to the subject matter herein.
C. Az. Agr. Mannucci Droandi reserves the right to, and may at any time revise this Agreement on the Site. Any such revisions are binding on you, and Az. Agr. Mannucci Droandi recommends that you revisit this page from time-to-time to review the then current Agreement.
